Everything Terms of Service

Welcome to Everything!
These Terms of Service ("Terms") outline your rights and responsibilities when you use our app, website, and services (we'll call them together the "Platform").
By creating an account, browsing listings, or completing a rental on Everything, you agree to these Terms. Please read them carefully. They explain how Everything works, what's expected of everyone using it, and what happens if things go wrong.
1. About Everything
Everything Creative, Inc. ("Everything," "we," "us," or "our") is a marketplace designed for creatives as a place to rent, buy, and share tools, spaces, and equipment locally.
Our mission is to help artists, designers, and makers access the things they need while making it easy for others to earn money from their idle gear.
We connect owners and renters, manage payments securely through Stripe, and aim to make creative resources more accessible and affordable.
Everything does not own, operate, or insure any of the items listed on the Platform. We're a facilitator. We are not a rental house, broker, or insurer.
2. Who Can Use Everything
To use Everything, you must:
- Be at least 18 years old (or the age of majority where you live).
- Have a valid government-issued ID and a Stripe-supported payment method.
- Provide accurate information during sign-up and keep your account secure.
We may suspend or close accounts that violate these Terms or compromise user safety.
3. Your Account
You're responsible for all activity under your account.
Keep your password private and notify us immediately if you suspect unauthorized use.
If your account is inactive, misused, or fraudulent, we may limit or disable it to protect the community.
You can delete your account anytime through the Help Center in the app.
4. Creating and Managing Listings
If you post a listing, you agree to:
- Accurately describe your item, space, or service.
- Include clear photos and note any wear, limitations, or special conditions.
- Set realistic prices and availability.
- Only list items you own or have explicit permission to rent out.
When a renter books your listing, you agree to honor that booking and be available at the agreed-upon pickup/drop-off time and location.
5. Renting Items
When you send a rental request, you're agreeing to the owner's listed price, availability, and location. Once accepted, your booking is confirmed.
You must:
- Arrive on time for pickups and dropoffs.
- Handle items carefully and return them in the same condition.
- Enter the owner's PIN code at pickup and dropoff — this verifies the exchange and serves as proof in case of a dispute.
If you're running late or need to reschedule, message the owner directly. Be aware that owners set their own cancellation and late policies.
6. Payments
All payments and payouts are processed securely through Stripe.
Funds are held until the rental is completed, after which the owner receives payment.
- Everything charges a small platform service fee on each transaction.
- Taxes and Stripe processing fees may apply.
- Owners are responsible for reporting income earned through the Platform.
We never store your full payment information directly — that's handled securely by Stripe.
7. Cancellations, Damages, and Disputes
Each owner chooses their own cancellation policy.
If an item is damaged, lost, or stolen during a rental, the renter may be responsible for repair or replacement costs.
Everything offers Everything Protect, an optional low-cost damage waiver and insurance solution for eligible rentals.
To file a claim, go to the item in your Rental Manager, tap the three-dot icon, then select Help → File a Claim.
Using the pickup and drop-off PINs helps verify the exchange and timestamp. This is useful for claims and dispute resolution.
If a disagreement arises between users, Everything may assist with mediation, but we are not liable for the outcome or responsible for enforcing agreements between users.
8. Safety, Conduct, and Community
Everything is built on trust and mutual respect.
You agree not to:
- Use the Platform for illegal or unsafe activity.
- Post false, misleading, or infringing content.
- Harass, threaten, or abuse other users.
- Circumvent or process payments outside the Platform.
- Damage, duplicate, or misuse Everything's software or brand materials.
We may suspend or remove users who violate these rules or create risk for others.
9. Our Role
Everything is a neutral platform that connects owners and renters.
We don't own or inspect items, verify conditions, or guarantee performance.
We do our best to support safe, transparent interactions, but we can't control how users act, use equipment, or fulfill bookings.
You use the Platform at your own risk.
10. Intellectual Property and Content
Everything's name, logo, design system, and brand materials belong to Everything Creative, Inc.
You may not copy, distribute, or modify our intellectual property without permission.
When you upload content (photos, text, videos), you retain ownership but grant Everything a non-exclusive license to display and promote that content as part of the Platform and its marketing.
11. Liability and Disclaimers
To the fullest extent allowed by law, Everything Creative, Inc. is not liable for:
- Any loss, damage, or injury resulting from user actions or transactions.
- Missed pickups, cancellations, or equipment issues.
- Errors, interruptions, or bugs in the Platform.
- Lost profits or indirect damages.
Everything is provided "as is," without warranties of any kind, whether express or implied.
12. Indemnification
You agree to hold Everything harmless and indemnify us against any claims, losses, or damages resulting from:
- Your use of the Platform,
- Your breach of these Terms,
- Your violation of another person's rights.
13. Changes to These Terms
We may update these Terms from time to time to reflect new features or legal requirements.
We'll notify you in-app or by email if changes are significant.
Continuing to use Everything after changes means you accept the updated Terms.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of New York, USA.
If a dispute arises, we encourage informal resolution first.
If we can't resolve it, you agree to binding arbitration or small claims court in New York County.
You waive any right to participate in class actions or collective lawsuits against Everything.
